Beta terms of service

These terms apply to the DocAIFlow service during its invitation-only private beta. They are a working agreement for a product that is being built, not the terms of a finished commercial service, and they will be replaced before the service opens to the public.

The service is provided by Diego Revuelta, Loredo, Cantabria, Spain (“we”, “us”). By creating an account you accept these terms.

1. What the beta is

The beta is free. No payment is taken, no card is collected, and no plan is sold. If and when charging begins, we will tell you before it applies to you and you will be able to decline by closing your account.

Access is by invitation. Registration requires an access code we issue; we may withdraw an invitation or end an account's access to the beta at any time, and we will give you the opportunity to export your data first except where we must act immediately to protect the service or comply with the law.

The beta has no service level commitment. It may be unavailable, restarted, changed or reset. Features may be added, altered or removed without notice.

2. Limits during the beta

Each organisation may keep 10 forms published at once, accept 1,000 responses per calendar month, and include 5 people. Drafting forms is unlimited, and unpublishing a form frees a slot.

These are beta figures chosen so the product can actually be evaluated, and they are not the limits of any future plan. They may change during the beta. We will tell you before reducing them.

Reaching a limit stops the action that would exceed it. It never deletes anything you have already created, and it never unpublishes a form that is already live.

3. Your content, and who is responsible for it

The documents you upload, the forms you build and the responses you collect remain yours. We claim no ownership and we use them only to operate the service for you.

When people fill in your forms, you are the data controller and we are your processor. That means you decide what you ask for and why, you are responsible for having a lawful basis, and you are responsible for telling respondents what you will do with their answers. We show respondents what the service stores; we cannot describe your purpose. The product privacy notice sets out how we handle data on your behalf, and it forms part of these terms.

You are responsible for the content of the documents you upload, including any personal data of third parties inside them, and for having the right to upload them.

4. Acceptable use

Do not use the service to:

We may suspend an account that is doing any of these, and will tell you why unless we are legally prevented from doing so.

5. Accounts and security

You are responsible for what happens under your account, for keeping your password to yourself, and for who you invite into your organisation. An invitation grants access to that organisation's forms and responses.

Anyone holding a form's share link can open the form and submit a response — that is what a public form is. Anyone holding an API key can read that organisation's forms and responses until the key is revoked. Treat both accordingly.

Tell us promptly at info@docaiflow.com if you believe an account, key or link has been compromised. Note that we cannot email you: the service has no email delivery, so we will contact you through whatever channel we have.

6. Closing your account

You can close your account at any time from within the service.

Deletion is immediate and irreversible. There is no grace period, nothing is archived, and we cannot restore an account or its data after the fact. It removes your account, every organisation in which you are the only member, and the forms, responses, answers and uploaded documents belonging to them.

Export first. The service produces a complete export of an organisation as a single file, and it is available at any time before deletion. We will not be able to produce one afterwards.

If you are the last owner of an organisation with other members in it, deletion is refused rather than removing a team's data along with a personal account.

7. Feedback

If you send us suggestions or feedback about the product, we may use them without restriction or obligation. This does not give us any right to your documents, forms or responses, which stay yours under section 3.

8. No warranty

The beta is provided “as is”. To the fullest extent permitted by law we make no warranties, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted, that data will not be lost, or that defects will be corrected.

Do not rely on the service as the only copy of anything that matters to you, and do not use it during the beta for a process where a failure would cause serious harm.

9. Liability

To the fullest extent permitted by law, and because the beta is provided free of charge, our total liability arising out of or relating to the service is limited to €100. We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data beyond that cap.

Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or any liability a consumer has under mandatory Spanish or EU law.

10. Changes to these terms

We may change these terms during the beta. Where a change materially affects you we will give notice before it takes effect. Continuing to use the service after that means you accept the change; if you do not, close your account.

These terms will be replaced by commercial terms before the service opens publicly or begins charging. That replacement will be notified, not silent.

11. Law and jurisdiction

These terms are governed by Spanish law, and the courts of Spain have jurisdiction. If you use the service as a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
